Do a liberty analysis of one controversy from “Scenarios from Actual Supreme Court Cases” at the very end of the textbook (and in the liberty analysis activities in Basic Principles).
Note: Your analysis needs to be from the perspective of the tradition we are studying. So for the purpose of this paper, for example, a fetus or unborn child is included in government protection of person and property, no exceptions.
The Assignment (How to do a liberty analysis)
For this assignment, you must discuss and apply the following features of liberty (in this order):
1. Living under a government that protects the person and property of all citizens, no exceptions
2. Living under a government that does not violate the person and property of citizens
4. Personal Liberty
If a particular feature of liberty does not apply to your controversy, you must explain why it does not apply and complete all other parts of the analysis (see steps described below).
Your liberty analysis should consist of five main paragraphs, each paragraph containing the following parts:
1. Begin your paragraph with a sentence stating which side of a controversy winning would promote liberty in the sense you are discussing (for example, “Smith would promote liberty in the sense of self-government.”) You need to name one side of the controversy as listed in the name of the Supreme Court case. If a particular meaning of liberty does not apply to your case, then state that.
2. Next, there must be a statement explaining why this side winning would promote liberty in this sense (or why it does not apply). For the why part, include the main definition that we have studied for the meaning of liberty you are discussing.
3. Next, use a primary source quotation from the relevant activity in the book defining the meaning of the part of liberty that you are discussing. (That is, the actual words of Madison, Blackstone, Locke, etc. and not someone explaining what they said). Unless you are confident that you can find an appropriate quotation on your own, please confine yourself to using the quotations in the textbook.
Note: When referring to a quotation in our textbook, cite the activity number and letter in the body of the text.
4. Then explain the quotation in your own words.
5. Finally, conclude the paragraph with a sentence in which you apply the primary source’s definition (using some of the actual words of the quotation in quotation marks) to the controversy you are discussing and explain why that side of the controversy would promote the meaning of liberty you are discussing (or why it does not apply), as defined in the primary source quotation.
Each of the five paragraphs is worth 20 points.
Please also include a brief introductory paragraph in which you state which controversy you will be discussing. If you wish, you may include a brief concluding paragraph in which you state anything else you wish to add about the controversy.
To repeat: You need a complete discussion or each of these meanings of liberty even if it does not apply to the controversy that you choose. If it does not apply, say that this meaning does not apply and then explain why. Then do the rest of the paragraph in the same way that you would in the case of a meaning that does apply.
1. If you do a controversy other than one of the controversies listed in “Scenarios from Actual Supreme Court Cases,” 100 points will be deducted from your grade on the mid-term.
2. If you write about more than one controversy, 25 points will be deducted from your grade on your mid-term.
3. If you copy any portion of your mid-term from any source, you will not receive any points for the parts that you copy and you will receive a penalty of up to 100 points, at the discretion of the instructor, depending on the severity of the copying.
4. 10 points will be deducted from your mid-term grade for each day (not class period) it is late (including weekends).
5. If the paper is not double-spaced, 10 points will be deducted from your grade. Papers that are not typed will not be accepted.
6. If you do not discuss the meanings of liberty in the order listed below, 10 points will be deducted from your mid-term grade.
7. If you do not discuss the parts of each paragraph in the same order as instructed in the directions, 10 points will be deducted from your mid-term grade.
8. If you quote from material that is not in the book, you must provide a hard copy of the material you use. If you do not do this, 10 points will be deducted from you mid-term grade.
